Terms & Conditions

Please read our Terms and Conditions (“the Terms”) carefully before booking. In these Terms the following definitions apply:

“Service” means any activity offered by or on behalf of The Studio (J A Health & Fitness Ltd) (including but not limited to both online (live-streamed / on-demand / recorded) and in-studio: classes, workshops, courses, retreats, events, private / 121). All services supplied by The Studio (J A Health & Fitness Ltd) are subject to the following Terms. By booking any service offered by The Studio (J A Health & Fitness Ltd) you are confirming that you have read the Terms and agree to be bound by them. In these Terms “we”/”us”/ “our” / “The Studio” / “The Studio Bartlow” means The Studio (J A Health & Fitness Ltd) . And “Student” / “you”/ ”your” / ”yours” means you, the direct client. “The Studio” means The Studio (J A Health & Fitness Ltd) premises at Unit 2 Three Hills Farm, Ashdon Road, Bartlow, CB21 4EN “Website” means www.thestudiobartlow.co.uk “Online” refers to any services that are live-streamed virtually or are recorded and shared digitally.

 

Any Service is subject to these Terms. The Studio (J A Health & Fitness Ltd) reserves the right to vary and revoke these Terms and Conditions from time to time which it may consider necessary or desirable for the regulation of the internal affairs of The Studio (J A Health & Fitness Ltd) and/or the conduct of Students. Any such changes will be published on the Website and, until revoked, are binding on Students.

These Terms also apply (as applicable) to a person who attends without payment as part of a promotional or other arrangement but has not purchased a Service.

These Terms and any disputes arising from them shall be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

 

LIABILITY WAIVER

In agreeing to this waiver, I agree not to hold The Studio (J A Health & Fitness Ltd) or its instructors / teachers / volunteers / supervisors / owners for any injuries or other misfortunes sustained while attending services. By participating in any of The Studio (J A Health & Fitness Ltd) services whether in the studio, online or at any other possible location, I do so at my own risk and adhere to the full terms and conditions. 

 

SPECIAL LIMITATION OF LIABILITY – CORONAVIRUS/COVID-19 PANDEMIC:

The Studio (J A Health & Fitness Ltd) cannot guarantee that you, your family, or your guests will not become infected with COVID-19. It is possible that attending classes, events and activities at The Studio (J A Health & Fitness Ltd) may place you in close physical contact with other attendees and teachers and could increase the risk that you, your family members, and/or your guests contract COVID-19.

You acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you, your family members and/or your guests may be exposed to or infected by COVID-19 at The Studio (J A Health & Fitness Ltd) and that such exposure or infection could result in personal injury, illness, permanent disability, and death. You understand the risk of becoming exposed to or infected by COVID-19 at The Studio (J A Health & Fitness Ltd) may result from the actions, omissions, or negligence of yourself or others, including, but not limited to, The Studio (J A Health & Fitness Ltd) employees, members, and attendees.

By enrolling online, and/or attending in person classes, events, activities and any other services and/or entering the The Studio (J A Health & Fitness Ltd) facilities and using equipment, you voluntarily agree, on behalf of yourself, your heirs, personal representatives and/or assigns, and any person or minor child you may enrol:

(a) to assume all of the foregoing risks and accept sole responsibility for any injury, illness, damage, loss, claim, liability, or expense, of any kind (including, but not limited to, personal injury, disability, and death) that may occur to you or your family members in connection with attendance at The Studio (J A Health & Fitness Ltd) or as a result of participation in The Studio (J A Health & Fitness Ltd) services (“Claims”); and

(b) covenant not to sue, The Studio (J A Health & Fitness Ltd) its teachers, clients, and employees, from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating there to, based on the actions, omissions, or negligence of The Studio (J A Health & Fitness Ltd), its teachers, students, attendees, and employees, whether a COVID-19 infection occurs before, during, or after attending The Studio (J A Health & Fitness Ltd) studio facilities or participating in any The Studio (J A Health & Fitness Ltd) service.

 

COVID19 REQUIREMENTS FOR STUDENTS

Attending an in-studio class:

Only visit the studio if you feel well. If you are unwell or showing any symptoms of Coronavirus, please do not visit The Studio (J A Health & Fitness Ltd).

All classes must be pre-booked, so make sure to sign up in plenty of time!

Please note our new cancellation policy - if you cancel within less than 12 hours you will lose your class pass and members/attendees will be charged the full amount of the class.

If you are unable to get into a class due to the new limited capacity, please consider joining online, as some of our studio classes are also live-streamed.

When booking, make sure you select the correct pricing option and version of the class either STUDIO or ONLINE.

Please do not arrive any earlier than 5-10 minutes to reduce the time you may have to wait outside the studio. If you are waiting outside the studio, please ensure social distancing.

We will not accept any latecomers.

To ensure your safety, and that of our teachers and other students, please sanitise your hands on entry to the studios.

We recommend you to wear a mask at all times when you are not on your yoga mat. We require you to maintain social distancing at all times. No wandering around the studio please.

Please arrive dressed for practice.  Where possible, please bring your own yoga mat and any props you may need. We have mats and props that you can use, but we ask you to sanitise them with our wipes after use. Place your mat down in one of the designated spots.

The bathroom and coat hangers / shoe storage will be available to use. We ask that you adhere to social distancing guidelines when using them and give your fellow students plenty of space.

We ask you to sanitise the area underneath and surrounding your mat after your class.

 

 

ONLINE SERVICES HEALTH & SAFETY

For anyone participating in any of our online services, you do so at your own risk, including our live-stream Zoom classes and any recordings. You take full responsibility for your health and safety, including any injuries. It is your responsibility to inform the teacher of any medical changes.

The Studio (J A Health & Fitness Ltd) services are for adults only unless the service is clearly stipulated for young people or families (for these services, it is the parent / guardian's responsibility to ensure the safe participation of people under 18. Please avoid attending online sessions if you are in doubt as to your ability to carry out the instructions safely.

Please note the live-stream classes are recorded and may be available on-demand or to view afterward, which may mean you are included within the recording.

We require you to:

Use a suitable, non-slip floor space and any potential obstructions in the vicinity are removed before you participate;

To avoid activities if you have, or suspect you may have, any current health concerns, injuries, aches and pains;

Inform the teacher at the start of the class if you have:

Any injuries, health concerns or conditions which affect your mobility or are likely to cause you concern when doing the session / class;

High blood pressure; low blood pressure/fainting; arthritis; diabetes; epilepsy; heart problems; asthma; depression; detached retina/other eye problems; recent fractures/sprains; recent operations; back problems; knee problems; neck problems; recent pregnancies; if you are you pregnant; or anything else that may affect your ability to participate safely.

Inform the teacher if you are a beginner / need any support before you start the session;

Avoid physical contact with other participants and where appropriate, adhere to social distancing guidelines;

Ensure that you have sufficient suitability to participate in these classes and choose those classes best suited to your ability.

 

FITNESS AND HEALTH

All customers participate in any activities taking place at the studio at their own risk.

All customers must inform their teacher and the Studio (hello@thestudiobartlow.co.uk) of any injuries, disabilities or issues that may affect their ability to participate in activities.

We advise all customers not to take part in one of the Services without first seeking medical advice if you/they have any concerns at all over their physical condition. You use the studio and take part in any of our services at your own risk.

If you have low/high blood pressure and/or cardiac irregularities - you should not attend class until you have written permission from your doctor. If there is any doubt, you should consult your doctor.

You must notify The Studio (J A Health & Fitness Ltd) of any circumstances affecting your health, which may be exacerbated through continued use of the Studio.

If you are pregnant, you must advise the teacher and be aware that if you are in the first trimester, you need to consult your doctor first before attending a class / session. After 12 weeks, you can attend classes specialised for pregnancy or at the individual teacher’s classes at their discretion. If the teacher agrees to you participating in class, this is at your own risk.

We reserve the right to refuse access to you or any customer if we in any way doubt your health and their ability to safely take part in the classes. By attending classes/courses/workshops you accept the risk of injury from performing any exercises in the Studio. The Studio (J A Health & Fitness Ltd) accepts no liability for injury to the customer.

By booking with us, all customers adhere to our full terms and conditions, which waive The Studio (J A Health & Fitness Ltd) responsibility for physical injury caused by any class/course/workshop or visit to the Studio.

 

UNDER 18S

Our standard timetable of classes are for adults only. We offer tailored services for under 18s. Booking our Kids and Teen classes (for under 18s) means you and the participant adhere to our full terms and conditions. Booking means you / your child has permission to attend a class at The Studio. The parent / guardian must inform the teacher of any injuries, issues, disabilities, or sensitivities that may affect their ability to participate in activities. Your child / teenager is participating in classes that require physical exertion, which may be strenuous, and you are fully aware of the risks and hazards involved. You understand that it is your responsibility to ensure your child is fit and healthy to attend. You represent and warrant that your child has no medical condition that would prevent her/his participation in physical fitness activities. In consideration of being permitted to participate in the classes, you agree to assume full responsibility for any risks, injuries or damages, known and unknown, which your child might incur as a result of participating. In further consideration of being permitted to participate in the classes, you knowingly, voluntarily, and expressly waive any claim you may have against the teacher, the owner, or the leaseholder of the building for injuries or damages that my child may sustain as a result of participating in classes or workshops held atThe Studio (J A Health & Fitness Ltd). If your child participates in other future classes or events at The Studio (J A Health & Fitness Ltd), you will also assume full responsibility for any injuries that may result from her/his participation.

 

BOOKING FOR SOMEONE ELSE

When booking for a friend or family member, each person needs to have their own registered account with The Studio / thestudiobartlow.co.uk (J A Health & Fitness Ltd). By booking for another person, it means both you and that person adhere to our full waiver and terms and conditions.

 

PREGNANCY

Our Pregnancy classes are for mums-to-be from 13 weeks and upwards. If you take part in these classes and / or other activities at The Studio (J A Health & Fitness Ltd), you do so at the risk of yourself and your unborn child. By participating in our Pregnancy Yoga classes you hereby agree to the following:

 

1. I acknowledge that I have consulted with my doctor or midwife prior to beginning these classes. I fully understand that I am participating completely voluntarily. I accept all responsibility for my health and any resultant injury or mishap that may affect my well-being or health and/or my baby’s well-being or health in any way.

2. I freely, voluntarily and with such knowledge assume the risk associated with prenatal exercise / yoga. I take full responsibility for the ramifications of my actions and physical condition in connection with my participation in the prenatal yoga classes. I understand that questions about yoga postures are encouraged and welcomed, and that students are encouraged to practice at their own pace, and only engage in poses that feel intuitively right for their bodies.

3. I hereby release The Studio (J A Health & Fitness Ltd) and its teachers, from any liability now or in the future. I hereby affirm that I have read and fully understand the above. In addition, I have read and accepted the full Studio's Terms & Conditions / Waiver.

 

BOOKINGS

All Services must be pre-booked and paid for in advance. It is not possible to book on arrival at the Studio.

It is your responsibility to ensure that you have made your booking and submitted payment correctly. Purchases are non-refundable.

If you have a multiple class pass, online booking automatically deducts a class from the pass. Passes are valid for a limited amount of time. Any credits that run over the time limit can not be used on bookings.  If a member, all classes included in your chosen membership type will have no cost attributed to them.

Additional Services / classes /workshops / courses must be paid for at the time of booking.

All purchases are assigned to one Student and ownership cannot be transferred, deferred or refunded.

All classes are offered by us subject to availability. We do not guarantee availability at any time. We reserve the right to cancel services at last minute.

 

CHANGE OF PRICES

We reserve the right to review and change the price of our classes and memberships at our sole and absolute discretion.

 

MEMBERSHIPS

Due to limited class sizes, we cannot guarantee you will get a space in your chosen classes.

 

AUTOPAY MEMBERSHIPS

When you sign up online for a rolling membership, you will pay for your first membership up-front by debit card or credit card and the following payments will be taken via direct debit. Your membership fees will be payable each cycle - for example, will become due weekly or monthly on the date that you began your membership, depending on the cycle you signed up for.

If your Membership Fees become overdue, we reserve the right to refuse you entry into our Studio and Services until the overdue sums are paid in full. Should you default on payments to us, we reserve the right to notify the default to a credit reference agency or other third party to obtain payment from you.

Any unused classes will expire, and you will be given a new allocation of classes when the next membership payment is taken.

 

MEMBER BENEFITS - UNLIMITED MEMBER - DIRECT DEBIT ONLY

Monthly direct debit members get up to £5 off workshops and 1 x free guest pass per month. Email: hello@thestudiobartlow.co.uk to redeem your guest pass (online members = online guest pass; and studio / online members can choose either)

 

‘CANCEL ANYTIME’ AUTOPAY MEMBERSHIPS

Anyone with a ‘cancel anytime’ autopay membership can do so at anytime with at least 24 hours notice (any less and the payment may already be processed and no refunds will be given). You must cancel yourself via your own account (thestudiobartlow.co.uk) cancellations via email will not be taken into account. Cancellations are immediate, so once cancelled you can no longer book classes (even if your membership had time left on it) 

 

UP FRONT MEMBERSHIPS

If you have signed up to a ‘pay up front’ membership (e.g. 1, 3, 6, 12 months), you cannot cancel your membership and are not eligible for a refund.

 

EXTENSION OF OFFERS 

Intro Offer and monthly memberships cannot be extended.

 

CANCELLATION POLICY

Please note our 12 hours Cancellation Policy when booking. By purchasing with us, you confirm you have read and accepted our full terms and agree to our 12 hours cancellation policy.

 

HOW TO CANCEL

In order to cancel your class and return it to your account or if a member, to not receive a penalty cancellation charge, you must cancel 12 hours prior to class start time.

Once your class is cancelled, the class pass will be returned to your account to be used at a future date; the class is not monetarily refunded. The class pass can be rescheduled for another time, if done before the 12 hour cancellation.

You can cancel your class booking by logging into your account, next to the class you wish to cancel, press “cancel” or “reschedule”

 

PENALTIES FOR LATE CANCELLATIONS + NO SHOWS

Early cancellations (cancel at least 12 hours before start of class) - You can cancel class bookings up to 12 hours in advance only. If you paid by class pass, your class will be credited back to your account.

Late cancellations and no shows (within 12 hours before start of class) - We understand that cancellations are sometimes unavoidable – but cancelling late or not attending at all often stops other students from booking places in that class. 

Class pass holders: If you do not cancel a class booking at least 12 hours of the class start time, you will lose the class pass and it will not be credited back to your account.

Members and Intro Offer pass holders: If you have signed up for the monthly / unlimited memberships or Intro Offer and you late cancel an in-studio class you may be charged £5. If you do not cancel at all and do not show up to an in-studio class, you may be charged £10. This will be charged to the card that your pass / membership payment is taken from. Our aim is to improve theThe Studio (J A Health & Fitness Ltd) experience for everyone and make it easier for all students to be able to attend the classes they want to. If you are on an unlimited contract or membership and you late cancel or no-show 3 in-studio classes over a month period, the option to book will be suspended for a month.

Courses and workshops - Courses and workshops cannot be cancelled or refunded - once purchased you have committed to the payment.

121 and private sessions - We operate a strict 24 hour cancellation policy on behalf of the private class teachers. For cancellations made with less than 24 hours notice or if you do not turn up for your appointment, you will be charged the full appointment fee in these circumstances.

 

ARRIVAL + LATENESS POLICY

Please arrive 5 minutes early.

If you arrive late, you will not be able to attend the class - out of respect for the teacher and other students.  This will be treated as a late cancellation. Please always check in with the teacher before your class, otherwise we will charge you as a no-show.

 

WAIT LIST

If a class is full, you can join the waitlist. Make sure you have opted in to emails, as you will be emailed if a space becomes available. Please check your emails, if you are added to the booking, you will be charged or it will be removed from your class pass.

 

WHEN WE CHANGE A BOOKING OR CANCEL A CLASS

We reserve the right to cancel booked classes, change the teacher and make schedule changes at short notice. If a teacher becomes unavailable, we will ensure – where practically possible – that they are replaced by another teacher. Where this is not possible or where a session is cancelled due to unforeseen circumstances, we will email to let you know.

At the time of cancellation, we will offer:

Class pass holders - Recredit your account with the class credit or the price of the cancelled class; or a refund if you made payment via the single class / drop-in option.

Members - We will recommend an alternative class to book and offer of a free guest pass for our livestream classes.

The Studio (J A Health & Fitness Ltd) will not be liable for any other incurred costs or damages caused to you from a cancellation.

 

REFUNDS

Any fees paid up front for any Service or membership will not be refunded.

 

CONCESSIONS & DISCOUNTS

No discounts or concessions are available on our monthly Direct-Debits, Drop-In passes or Introductory Offer.

No additional discounts or concessions are available in conjunction with any special offers.

Only one discount or concession can be applied at one time.

 

 

GENERAL

In the event of a fire you are asked to exit out of the nearest door (at the front of the Studio).

The Studio (J A Health & Fitness Ltd) is an outdoor shoe free zone. All outdoor footwear is to be removed at the entrance to the Studio. Indoor clean shoes can be worn for classes.

All mobile phones must be kept on silent in bags or coats.

For safety reasons and because some of our customers are barefoot – no crockery, glass or anything breakable is permitted in any part of the Studio.

No food is to be consumed within the Studio.

You should not walk around the Studios barefoot if you have verrucas or similar foot complaints.

We reserve the right to refuse entry or expel you from the Studio should your conduct be deemed unfit or should they be deemed to be in breach of the Terms. In such instances, The Studio (J A Health & Fitness Ltd) will not refund you.

 

POLICIES CONTINUED

Compensation

We will compensate you for any loss or damage you may suffer as a result of a breach of the duties imposed on us by law. However, our liability to you may be mitigated to the extent the loss or damage is attributed to:

• your own fault;

• a third party unconnected with the provision of our services; or

• events which we could not have foreseen or avoided even if we had taken all of the responsible precautions our liability to compensate you (other than in the case of personal injury or death caused by our negligence) will be limited to £250 having regard to such factors as whether the loss of damage was due to a negligent act or omission by us.

Our liability to compensate you (other than in the case of personal injury or death) will be limited to a reasonable amount having regard to such factors as whether the loss or damage was due to a negligent act or omission by us.

 

FORCE MAJEURE

We shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms , if the delay was due to any cause beyond reasonable control, including, but not limited to, Acts of God, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T, viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery.

 

WAIVER

No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing.

 

SEVERABILITY

If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.

 

DATA PROTECTION

We, The Studio (J A Health & Fitness Ltd), will use your personal details and information to provide you with use of our services and facilities, to administer and maintain our membership records, to process your application and payments, to verify your identity and to carry out market research. We may keep your information for a reasonable period for these purposes. We may share your information with our service providers in order to provide you with The Studio (J A Health & Fitness Ltd) services, and with other third parties to comply with our legal or regulatory obligations, for the prevention of fraud or other crimes, and in the case of medical emergencies. If your personal details change, if you change your mind about how you wish to be contacted, or if you have any queries about how we use your information, please let us know by contacting hello@thestudiobartlow.co.uk. You hereby consent to the use of your information, including sensitive personal data relating to your health and fitness, for the reasons and in the manner set out above.

 

PERSONAL BELONGINGS

Personal belongings brought to the Studio are at your own risk. The safety of the possessions are not the responsibility of The Studio (J A Health & Fitness Ltd). We do not accept liability for loss or damage of personal possessions except in so far as such loss or damage is by law incapable of exclusion. All lost and left property will be disposed of within 14 days.

HEALTH FORM 

In addition to reading this Clients will be required to fill out and submit the following form to The Studio (J A Health & Fitness Ltd) prior to receiving a Fitness Consultation, Training Program Design, or beginning any Personal Training programme.

The Physical Activity Readiness Questionnaire (PAR-Q)/ Health History Questionnaire must be completed before a class/session/121/workshop. The form can be found on all booking pages and link at the bottom of the website (thestudiobartlow.co.uk) As a member you may be asked to repeat this from time to time to keep our records up to date

It is your responsibility to let an instructor know with any changes to your health and that they are updated

This is your responsibility, and we ask every starting participate to do this. This is now filled in electronically on the website and no need to print

Health 

If you have any of the following physical conditions, you may be required to have a Medical Clearance and Physician’s Consent Form:

  • Hypertension (>145/95 mm Hg)

  • Heart Conditions

  • Hyperlipidemia (cholesterol >220 mg/dl or a total cholesterol-to-HDL ratio of >5.0)

  • Diabetes

  • Family history of heart disease prior to age 60

  • Smoking

  • Abnormal resting EKG

  • Any other condition that The Studio (J A Health & Fitness Ltd) in its sole discretion may deem to present an unreasonable risk to your health, were you to participate in a fitness evaluation or program.

(This is not an extensive and there may be other health conditions where you require medical clearance) 

Sessions 

Unless other arrangements are made, personal training sessions, and Program Design explanations (these services herein individually and collectively referred to as ‘sessions’) last approximately 60 minutes. All classes will last around 45 minutes. Workshops can vary from 60minutes to a full day. In order to provide the best service to all Clients, The Studio (J A Health & Fitness Ltd) cannot commit to extending any particular session beyond its previously scheduled time.

In order to provide the best possible service to all Clients, The Studio (J A Health & Fitness Ltd) asks that all Clients be ready to begin their session at the scheduled time. Time lost at the beginning of a session due to a client’s lateness cannot be made up at the end of the session as that could potentially impact the next scheduled clients/ class

Shirts (Sports tops) and shoes (Adequate trainers/ sport footwear) are always required during weight training sessions. Clients should also have water available as necessary during the workout and wear suntan location in higher temperatures, when attending an outdoor session. It is a client responsibility if he/she is prone to burning in the sun

Clients have the right to terminate a particular exercise or workout at any time. You are in control of your workouts! If an exercise is uncomfortable or painful, or if you want to stop for any reason, you may do so. If a particular exercise is painful for you to do or you have an injury or other limitation that makes it difficult for you to do, The Studio (J A Health & Fitness Ltd) can attempt to substitute another exercise to work that muscle group.

You will get from your workouts what you put in. Results will vary by individual and The Studio (J A Health & Fitness Ltd) cannot guarantee specific results. Client acknowledges that Client is responsible for their decisions regarding whether to exercise consistently, eat properly, rest enough, and live a healthy lifestyle.

The age limit for participates is 16 and above. 14-16 year olds may train as long as they are accompanied by a parent or guardian. Parents or Guardians are responsible for their children at all times. Parents / Guardians will also be asked to fill in a Health form. Due to the nature of some of the exercises we may from time to time ask the person of age 14-16 not to join in the session as a purely safety precaution.

We advise at certain times of year you acquire insect repellents, lotions, or spray to avoid bites and stings. This is advisory and we ask that you check before that you are not allergic to any product before use
